Visitor to Work Permit in Canada: What Changed and What Still Works in 2026
The visitor work permit policy ended in 2024. Here's what still works, who qualifies, and what to avoid.
You came to visit family in Brampton. A local employer likes you and wants to hire you. So can you just apply for a work permit and stay?
A few years ago, the answer was often yes. Today, it's usually no. The rules on going from visitor to work permit Canada changed in 2024, and lots of people are still acting on old advice. Here's where things stand now.
The Public Policy That Ended
During the pandemic, IRCC let visitors inside Canada apply for an employer-specific work permit without leaving the country. All they needed was a valid job offer and valid visitor status.
That temporary public policy ended on August 28, 2024. IRCC said it was part of its plan to bring down the number of temporary residents and to reduce fraud.
So if a friend got a work permit this way in 2023, that path isn't open to you now.
What the General Rule Is Today
Most visitors can't apply for a work permit from inside Canada. Instead, you'd usually need:
- A real job offer backed by a positive LMIA, or an LMIA-exempt offer
- A work permit application submitted from outside Canada, to a visa office
- Valid visitor status the whole time you remain in Canada while it's processed
And here's the part people miss. You can't start working while you wait. Visitors may attend interviews, but working without a permit can lead to a removal order and a ban.
Who Can Still Apply From Inside Canada
Some people do have an inside-Canada option, because they qualify under a separate category:
- Spouses of certain skilled workers or students who meet the current open work permit rules
- Inland spousal sponsorship applicants who've received their acknowledgement of receipt
- Some CUSMA professionals and intra-company transferees from the US or Mexico
Each category has its own fine print. A spouse's eligibility, for example, depends on the principal worker's TEER level and the time left on their permit. Check your category before assuming it applies.
A Common Brampton Scenario
Picture a young man from Ludhiana visiting his uncle in Brampton. A trucking company offers him a job. He's excited, so he starts "helping out" at the yard while he figures out the paperwork.
That's unauthorized work. If it comes out later, it can damage every future application he makes. The better route is to go home or stay as a genuine visitor, let the employer apply for an LMIA, and file the work permit properly.
Watch for These Red Flags
- Anyone promising a work permit "from inside Canada" for a visitor without a clear legal category
- Being asked to pay for a job offer or an LMIA (employers can't charge workers for this)
- Advice to leave and re-enter at the border to get a permit quickly, without checking current rules first
