It is a reasonable thing to ask, but the answer is not as straightforward as it sounds. Recruitment agencies in Mumbai do not get one universal government certificate covering all types of hiring. Different registrations apply to different activities, and each one comes with its own compliance requirements. Checking the registration that actually matches your hiring model gives you more useful information than an "approved" label on a website. The Government Stamp That Does Not Exist
India does not have one central licensing system for agencies that recruit candidates for permanent jobs within the country. There is no ministry-issued document officially called an "approved recruitment agency" for domestic hiring. If an agency uses that description, ask two simple questions: approved under which law, and for what type of activity?
A reliable agency should be able to give you a clear answer. A company handling permanent recruitment needs to operate as a properly registered business and issue valid invoices. An agency providing contract manpower through its own payroll has additional statutory responsibilities. A business recruiting candidates for overseas employment falls under a different regulatory framework and requires authorization from the Ministry of External Affairs. These are separate activities, so registration for one does not automatically authorize the others.
Match the Registration to Your Hiring Model
Permanent placement is usually the more straightforward arrangement. The selected candidate joins your payroll, while the recruitment agency charges an agreed professional fee. Basic checks should include the agency's incorporation or partnership records, an active GSTIN that can be verified on the GST portal, and invoices carrying the same legal name mentioned in the agreement. GST should be charged as applicable to the service. If the company name on the contract does not match the name on the invoice, stop and clarify the difference before proceeding.
Contract staffing follows a different structure. The employee may work at your premises, but the staffing agency remains the employer on record. The agency therefore has responsibility for applicable statutory registrations and monthly contributions, including EPFO and ESIC where applicable. Depending on the workforce and contractual arrangement, licensing requirements may also apply under labor laws, including the Occupational Safety, Health, and Working Conditions Code. Do not ask only for registration numbers. Request relevant contribution challans or other compliance records where appropriate. A registration shows that an account exists; a challan provides evidence of an actual payment.
When a Vendor Cuts Corners, the Bill Comes to You
Many Mumbai employers learn this too late. Under Indian labor law, the company where contract staff actually work is the principal employer. If the staffing vendor skips provident fund deposits or pays below statutory wages, the authorities can recover those dues from the principal employer. The principal employer is then left to recover the money from the vendor.
Now that the labor codes are in force, principal employers are expected to keep more documentation, not less. A cheap markup from a poorly registered vendor can end in an inspection notice, backdated contributions, and interest. Every contract staffing agreement should give you the right to audit the vendor's statutory payments, and you should review those payments every quarter.
The Maharashtra Layer That Outside Vendors Miss
Hiring in Mumbai is governed by state rules as well as central ones. Offices in Maharashtra fall under the Maharashtra Shops and Establishments (Regulation of Employment and Conditions of Service) Act, 2017, which requires registration once an establishment employs ten or more workers. An agency with a genuine office in the Mumbai region should be able to show this registration.
Two smaller obligations show whether a vendor understands local payroll. Maharashtra deducts professional tax from salaries, and the Maharashtra Labour Welfare Fund collects contributions twice a year, in June and December. Sometimes a vendor from another state quotes a cost-to-company figure with neither line item. That means it has either overlooked them or intends to add them later, and both are poor signs. Ask for a sample salary breakup before you approve rates.
Hiring for Roles Abroad: One License Decides
The rules become much stricter when a Mumbai company recruits for an overseas subsidiary or when a foreign employer hires Indian professionals through a Mumbai agency. Under the Emigration Act, 1983, only recruiting agents registered with the Protector General of Emigrants may recruit Indian nationals for employment abroad. Registered agents are listed on the government's eMigrate portal, and the registration number should appear on the agency's letterhead and advertisements.
Overseas recruitment is the one area where "government approved" has a literal meaning that you can check. An agency without an eMigrate registration should not handle overseas recruitment, however established it appears.
What to Request Before the First Interview
You do not need a compliance department to screen a vendor. Ask the agency for a short file containing:
- Its certificate of incorporation or registration
- Its GST registration certificate
- Its Shops and Establishments registration
For contract staffing, its EPFO and ESIC codes with the last three months of challans
Then check the GSTIN and the company name on the public government portals yourself, which takes only a few minutes.
Next, read the agreement for three points: the replacement period if a candidate leaves early, the exact event that triggers the fee, and how candidate data will be handled under the Digital Personal Data Protection Act. A vague answer on any of these is a warning sign.
