When your CDL License is in Jeopardy

To many drivers, a traffic offense is a simple matter.  To an individual who holds a commercial driver's license (“CDL”), a moving violation can become a nightmare experience.  This even includes tickets issued while using your personal vehicle.  When your CDL license is in jeopardy, you need competent legal representation.  Otherwise, you may be looking to change careers.

Regulations Concerning Truck Drivers

Truck drivers in California are subject to both state and federal regulations.  The Federal Motor Carrier Safety Association (“FMCSA”) is the federal agency that oversees truck operators.  However, the California Division of Motor Vehicles issues the actual CDL.  The state agency’s regulations mirror those set forth by the federal government.  In some cases, they are even more stringent.  Bottom line, the intent is to keep the road and drivers safe.

Moving Violations for Truck Drivers

There is a higher standard applied to those who get behind the wheel of big rigs and other large trucks.  Obviously, the bigger the vehicle, the more chance for a catastrophic accident.  Here are some examples of traffic tickets that the SRAI Law Office has defended:

  • Speeding violations
  • Driving under the influence of drugs or alcohol
  • Improper lane changes
  • Following too closely
  • Reckless driving
  • Cell phone violations
  • Leaving the scene of an accident

Other Types of Truck Violations

A truck driver may also receive citations for failing to properly maintain a vehicle.  In addition, tickets may be issued for uneven or overweight loads.  The failure to complete logbooks is also subject to scrutiny.

CDL License Suspension or Revocation

The motor vehicle point system for CDL license holders becomes amplified when they are behind the wheel of a commercial vehicle.  The violation points are increased by one and one-half of the normal point value.  Class A license holders cannot forego points by attending traffic school. In addition to state regulations, the FMCSA can effectuate a CLD license suspension for even the first traffic ticket.

Unfortunately, a license suspension can come as a result of just a few points appearing on your license.  This could be more than a temporary measure.  Often, employers are reluctant to take a chance on drivers who do not have clean licenses.
